Streamlining Municipal Property Transactions in South Africa for Enhanced Social Value Creation

The paper examines how the legislation governing the sale and lease of immovable property by South African municipalities impacts the municipalities’ ability to deliver social value to their communities (PDF, 431KB). It focuses on two metropolitan municipalities, City of Cape Town and eThekwini to analyse how they apply these legal requirements in practise. The study highlights challenges municipal officials face when complying with complex and overlapping legislative frameworks designed to ensure transparency and prevent corruption. The paper argues that these legal requirements may unintentionally hinder social value creation and suggests legislative improvements to streamline property transaction processes while maintaining good governance.
